1. Agreement to Terms
By accessing or using Bert CLI ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Software.
Bert CLI is provided by Amphydia Industries ("we," "our," or "us").
2. License
Bert CLI is licensed under the Apache License 2.0. This means you are free to:
- Use the Software for any purpose
- Modify the Software
- Distribute copies of the Software
- Distribute modified versions of the Software
Subject to the conditions of the Apache 2.0 license, including maintaining copyright notices and providing attribution.
3. Good Faith Usage
While the Apache 2.0 license grants broad permissions, we ask that you use Bert CLI in good faith. Specifically:
Please Do Not:
- Bypass the Token System: Do not modify the code to circumvent authentication or token validation to avoid fair usage limits.
- Abuse the Service: Do not create multiple accounts, use automation to generate excessive tokens, or otherwise abuse the token system.
- Strip Attribution: When redistributing modified versions, please retain attribution to Amphydia.
- Harmful Use: Do not use Bert to generate spam, harassment, malware, illegal content, or content that harms others.
We Encourage You To:
- Use Bert freely within the 20,000 tokens/week limit
- Contribute improvements back to the project
- Report bugs and suggest features
- Share Bert with others who might benefit
- Contact us if you need higher limits for legitimate use cases
4. Token System
Bert CLI uses a weekly token system to ensure fair access:
- Each user receives 20,000 tokens per week
- Tokens are tied to your email address
- Tokens reset every Sunday at midnight UTC
- One token per email address per week
The token system exists to ensure sustainability and fair access for all users, not to restrict legitimate use. If you need more tokens, please contact us.
5. Acceptable Use
You agree not to use Bert CLI to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Generate spam or unsolicited commercial content
- Generate malware, viruses, or malicious code
- Impersonate any person or entity
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Generate content that exploits or harms minors
6. AI-Generated Content
Bert CLI uses AI language models to generate responses. You understand and agree that:
- AI-generated content may not always be accurate, complete, or appropriate
- You are responsible for reviewing and verifying any AI-generated content before use
- We are not responsible for any decisions or actions you take based on AI-generated content
- AI models may occasionally produce unexpected or inappropriate outputs
7. Privacy
Your use of Bert CLI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Key points:
- Your conversations stay on your local machine
- We only collect your email for token management
- We never sell your data
8. Disclaimer of Warranties
BERT CLI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Software will meet your requirements
- The Software will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Software will be accurate or reliable
- Any errors in the Software will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMPHYDIA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Software
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the Software
- Any bugs, viruses, or other harmful code that may be transmitted through the Software
- Any content or conduct of any third party
10. Indemnification
You agree to indemnify, defend, and hold harmless Amphydia from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of Bert CLI or your violation of these Terms.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of Bert CLI after any changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your access to Bert CLI at any time, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Software will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
